Late Payment Policy
- Payments not received by the due date may result in a pause of active campaigns and deliverables.
- Realtytics reserves the right to withhold final creative assets, reports, and data until all outstanding dues are cleared.
- Continued delay beyond 10 days from the due date may lead to contract review or suspension of services.
- Resumption of services post payment delay will be subject to a rescheduling window of 3 to 5 working days.
Refund Policy
Realtytics operates on a no-refund policy once services have commenced. The following applies:
- No refunds shall be entertained once a project has started or once creative or strategy work has been initiated.
- Platform ad budgets (Meta, Google) are non-refundable as they are paid directly to third-party platforms.
- In case of early termination, the client is liable to clear all pending dues for work completed up to the date of termination.
- Any advance paid for a future month will be adjusted against the final settlement upon termination.
Contract Duration & Termination
- A minimum engagement of 3 months is required for all retainer-based services.
- Either party may terminate the agreement with a written notice of 15 days.
- Upon termination, all pending invoices must be cleared before final delivery of creatives, reports, or account data.
- Any strategy, concept, or content developed prior to termination remains the intellectual property of BMS & Co. unless explicitly agreed otherwise in writing.
Scope of Work & Additional Charges
The monthly retainer covers deliverables as agreed in the signed Statement of Work (SOW). The following will be billed separately:
- Any work outside the defined scope, including additional platforms, extra creatives, or new campaigns.
- Rush deliverables requested with less than 48 hours turnaround time.
- Third-party tool subscriptions or platform fees required for execution.
- Any offline events, shoots, or physical production requirements.
Client Responsibilities
To ensure smooth execution and timely delivery, the client is expected to:
- Provide all required access — ad accounts, social media platforms, GMB, CRM, website — within 3 working days of onboarding.
- Share brand assets, content, product details, and approvals in a timely manner.
- Assign a single point of contact for all communication with the Realtytics team.
- Approve designs, captions, creatives, and budgets within 48 hours of submission to avoid delays.
Any delay from the client side that impacts timelines or results will not be the responsibility of Realtytics.
Performance Disclaimer
Marketing results are influenced by several external factors beyond our control, including:
- Platform algorithm changes (Meta, Google, Instagram)
- Seasonality and market conditions
- Competitor activity and consumer behaviour
- Ad budget levels and audience targeting limitations
Realtytics ensures best-in-class strategy and execution at all times. However, specific results in terms of leads, revenue, reach, or conversions cannot be guaranteed.
Confidentiality
- All client information including business plans, data, campaign details, and audience insights will remain strictly confidential.
- Realtytics will not disclose or reuse any client data for any other project without prior written consent.
- Realtytics reserves the right to use completed deliverables in its portfolio unless the client explicitly requests otherwise.
Legal Jurisdiction
- All agreements shall be governed by and construed in accordance with the laws of India.
- Any disputes arising shall be subject to the jurisdiction of courts in Navi Mumbai, Maharashtra.
- Realtytics shall not be held responsible for any delay or failure caused by circumstances beyond its control including natural disasters, pandemics, server failures, or platform-wide outages.
